Challenge to US abortion laws – could we see a momentous decision?

A case is currently before the US Supreme Court, the outcome of which could be “absolutely momentous” and a godsend for unborn babies – by upending Roe vs Wade. As many will know, Roe v Wade was the landmark American legal case in which the U.S. Supreme Court ruled in 1973 that individual state laws banning abortion were unconstitutional. This case is the basis upon which abortions have been legalised and millions of unborn babies killed.

The 1973 outcome of Roe vs Wade has not stopped the ongoing battle to prevent abortions in America. Many US states are now passing ‘Fetal Heartbeat Bills’, banning abortions as soon as the embryonic or fetal heartbeat can be detected. None of these bills, however, have gone into effect, all being held up in the courts.

But now the US Supreme Court has decided to hear what could be another landmark case – Dobbs v. Jackson Women’s Health Organization, No. 19-1392. This case deals with the lawfulness of a 2018 Mississippi state law that banned abortion operations after the first 15 weeks of pregnancy. Gallup polls indicate that less than 3 in 10 Americans support abortion after 15 weeks.

With its law temporarily blocked by the federal court, the State of Mississippi is asking the Supreme Court to uphold its state law, thereby directly challenging the foundation of Roe v. Wade. Remarkably the Supreme Court has agreed to a hearing. The stakes could not be much higher.

This is one to the most direct challenges to Roe vs Wade in nearly 40 years. Mississippi Attorney General Lynn Fitch recently stated that the court should overturn their 1973 ruling, also stating, in a detailed filing to the court, that

“nothing in constitutional text, structure, history, or tradition supports a right to abortion”

“As confirmed by the release of Justice Harry Blackmun’s private papers in 2004 (Blackmun was the author of Roe), “the Supreme Court in 1992 was ready to effectively overturn the landmark Roe v. Wade ruling legalizing abortion, but Justice Anthony M. Kennedy got cold feet, and the vote went the other way.” This means that, had Kennedy held his ground, Roe would have been overturned almost 30 years ago. (How many tens of millions of babies have been killed in the womb since then?)

Yes, just dwell on that for a moment … the actions of one man, and his swing vote, has resulted in the killing of many millions of unborn babies.
